Jane Brady is a very highly regarded criminal practitioner whose advocacy, case preparation and client care have always set her apart.

She was briefed to represent a 13 year old charged with murder when she was just 3 years’ call.

Jane was offered 3 pupillages at Bar School and chose to return home to the north and to St Paul’s where she was Howard Crowson (now HHJ Crowson)’s pupil from 2001 to 2005. In 2005, following her marriage, she moved down to 13KBW in Oxford, joining with Cornwall Street Barristers in Birmingham in 2014, where Jane played a key role in the merger. She was asked to consider becoming Head of Chambers in 2020, just prior to a move back north for personal reasons. Since when, she has established herself, once again, as sought-after Counsel for heavyweight cases. Predominantly cases of serious violence and drugs, with one Judge referring to her as a ’Shining Light’ when she walks into court.

In 2021, Jane was commended by Mr Justice Wall in open court at sentence – “Unusually I also commend Miss Brady, the Prosecution junior, who, I am told, received instructions in this case when it was a relatively small fraud but, after examining the case papers encouraged the reopening of the case so that justice could be done”. The case had come to Jane as a £12k benefit fraud at PTPH; the first defendant was convicted of murder 2 years later after trial.

Jane subsequently received a Chief Constable’s Commendation for Excellence in 2024.

A tenacious opponent, she is a stickler for detail and disclosure and is determined to do justice to a case. Jane has appeared at the Court of Appeal and has always been successful on her own cases – including an entry in Banks on Sentence in R v G and M 2015 EWCA Crim 32 – Sex Offences with Children. Defendant aged 16-17.

Jane was personally thanked by the Court of Appeal Judges at the start of their judgment in R. v McKellar (Aaron), [2019] 1 Cr. App. R. (S.) 21 (2018): “We are very grateful to her for that document which has been of great assistance to us”.

Expertise

Jane is a Grade 4 Prosecutor and defends and prosecutes the most serious cases for a Junior, often involving legally complex issues, expert evidence and vulnerable witnesses and defendants.

Jane is briefed in the full spectrum of criminal cases including: murder, attempted murder, serious violence (baby shaking, s.18, armed robbery, kidnap), arson, bomb hoaxes, drugs conspiracies, fraud, CSE, child cruelty, sexual offences, prison officer misconduct and road traffic cases including fatalities.

Jane has has worked for HM Revenue and Customs, the Department for Business, Innovation and Skills, the Health & Safety Executive and the Post Office. She has conducted complex confiscation hearings with success for both the Prosecution and Defence, due to her accounts expertise (Jane worked for PWC in Madrid as an Auditor for a year and spent 2 years at KPMG, Leeds in the Financial Sector Group).

 

Notable Crime cases


Prosecution

Successful prosecution of 2 Defendants for Child Cruelty of 3 children spanning more than 4 years and including allegations of sadism and strangulation.

Conviction of a School Teacher for Drugs Supply after a contested Newton Hearing.


Prosecution

Prosecution of 5 Defendants for large scale under-cover Drugs Conspiracy in High Wycombe area. Pleas to Indictment from all.


Defence

Defence of multiple rapist, involving filming, threats, indecent images, distribution. Early guilty pleas to 20 count Indictment and avoidance of life sentence.

Defence of knife-point stranger rape. Negotiated acceptable early pleas to amended Indictment.

Junior counsel in 2 large CSE cases; latter case with 11 defendants, Defendant acquitted of multiple rapes.

Successful defence of very vulnerable woman accused of Armed Robbery; Defendant was granted an intermediary for the entire trial, she gave evidence and was acquitted.

Defendant charged with Child Cruelty of 2 children and multiple rapes of one child. 2 hung juries despite compelling witnesses and evidence, following which the Crown offered no evidence.

Successfully defending NCA Prosecution of Ms Rasha (wife of Kuqi) for Importation of Cocaine into the UK. Defendant, who could not speak English well, gave evidence and was acquitted.


Defence

Defending client charged with rape of a boy following acquittal for previous alleged rape of different boy some years ago. Jane contacted previous Defence Counsel and successfully defended the Crown’s application to adduce the acquittal. Defendant was acquitted of the more recent allegation also.


R v Merrilees

Successfully defending client charged with murder, aged 21, of good character and acting in self-defence. Main witnesses to the alleged murder became defence witnesses.


R v Potter

Representation of Defendant charged with murder. 41 eye witnesses to prepare for cross examination.


Defence

Sole Counsel for 3rd Defendant in a 19-handed, million pound drugs conspiracy involving 3 different conspiracies and Police forces.


Defence

Junior Counsel defending an Animal Rights Activist in a 3 month trial in Winchester. Over 120 lever arch files. Only defendant of 8 on trial to be acquitted by the jury.

Significant Cases Include


R v Rickard

Advising pre-charge on a complex Murder and Gross Negligence Manslaughter case. After an 8 week trial, being led by Oliver Saxby QC, a conviction for Murder followed in a ‘ground-breaking’ case for CPS. Jane was personally commended in open court by the High Court Judge at sentence and she received a Chief Constable’s Commendation award. The case was covered in all national media including BBC and Sky News

R v Franklin

Together with Rupert Doswell KC, Jane prosecuted a complex 8 week murder trial involving contested video, audio and DNA expert evidence. Jane also had to deal with her original leader falling ill on day 4 and pulling out of the case completely. Jane held the fort for the prosecution, instructed Rupert Doswell KC, and kept the trial on track, to secure a conviction for murder ultimately.
