A prenuptial agreement is a contract that is entered into before a marriage or civil partnership. Prenuptial agreements give couples the autonomy to regulate the finances both within their marriage and to define what will happen should it come to an end.
Whilst pre or postnuptial contracts or agreements are not absolutely binding in England, the court will seek to uphold the contract provided it is not tainted by unfairness. A court awarding one party different or greater provision is not, in itself, unfair.
