Arbitrators are typically senior counsel with extensive experience in the family courts. For more information on arbitration, see the website of the Institute of Family Law Arbitrators (IFLA).
Arbitration is suitable for all forms of family financial disputes, whether arising from divorce, dissolution of a civil partnership, or separation after living together. It offers a bespoke solution to those who are unable to reach a consensual resolution to their financial dispute but who wish to avoid the courtroom. It is voluntary, but once the parties submit, the decision is binding and will be made into a consent order to be placed before the Court for approval. Only in very exceptional circumstances will the Court decline to approve the arbitration award. Arbitration in financial proceedings has received wide spread judicial approval.
