They argued and sought to demonstrate that there was no decision to charge and try E in Italy, which amounts to a complete defence under the Extradition Act. As such they prevented E from being extradited to Italy, avoid detention pending trial for many months, and exposed the weaknesses of the prosecutor’s evidence against her and the holes in the Italian investigation.
