E v Italy – Cross Jurisdictional Conspiracy to Traffic Drugs

Hannah Hinton, instructed by Gitana Megvine and Ruta Mikailaite at Oracle Solicitors succeeded in a discharge of a warrant issued by Italy to return Ms E for an investigation of a major cross jurisdictional conspiracy to traffic drugs.

To preserve client’s reputation and impeccable character was paramount in this case from the outset, as their client was a female with no previous criminal records.

They teamed up with Italian lawyers in order to discharge the warrant in Italy. They argued and sought to demonstrate that there was no decision to charge and try E in Italy, which amounts to a complete defence under the Extradition Act. They worked for over a year and succeeded in having finally the warrant discharged.  As such they prevented E from being extradited to Italy, avoid detention pending trial for many months, and exposed the weaknesses of the prosecutor’s evidence against her and the holes in the Italian investigation.

They worked very hard and successfully preserved E’s liberty, her good reputation, clean criminal record and established private life in the UK.
