
Led by Sam Green KC, with Kristina Goodwin as junior counsel and instructed by Priestley Legal, the defendant, Thomas Dear was originally charged with murder, Thomas Dear ultimately pleaded guilty to manslaughter after the prosecution accepted that the evidence did not support an allegation of intent to kill. The case arose from a tragic and highly charged confrontation between father and son, captured on CCTV, during which Thomas Dear said he acted in self-defence.
The CCTV footage showed a prolonged and volatile argument, with both parties engaging in aggressive behaviour. Importantly, the evidence demonstrated that Mr Dear Senior approached his son wielding a garden fork, and that the fatal act occurred in circumstances far removed from a premeditated or intentional killing. The defence case was that the brick was thrown in panic, with the aim of stopping an imminent threat rather than causing fatal harm.
The 20-year-old, of no fixed abode, was ordered to serve three years and four months at a young offender institution at Nottingham Crown Court
