Deprivation of Liberty Safeguards (DOLS) are included in the Mental Capacity Act 2005. They pertain to a person’s liberty in cases where they may not be able to make choices in their own best interests, such as in the case of mental illness or in full-time care. DOLS ensure that the care that restricts the person’s liberty is appropriate and in the person’s best interests.
The DOLS team is led by Simon Bickler KC, who has a breadth of experienced counsel from junior call to senior juniors and those in silk.
Our members are experienced in the preparation and making of Section 21A applications challenging authorisations of deprivation of liberty in a care home or hospital under the Deprivation of Liberty Safeguards (DOLS).
