Our barristers deal extensively with the drafting of and advice on trusts of all kinds: not only traditional family trusts but also governmental and commercial trusts. A trust lawyer also provides expertise in relation to charitable trusts, and advise on constructive trusts, proprietary estoppel and asset recovery. Our members recognise that pension trusts are also increasingly important.
Trustees’ powers, the variation of trusts, breaches of trust and breaches of other fiduciary duties are all part of the work conducted by our civil and family lawyers, as are the tax consequences of any actual or proposed step in the administration of a trust. Our barristers offer practical advice on the use of trusts for a range of purposes, and are happy to undertake or assist in the drafting of all necessary documentation.

What is Trust Law?
Trust law involves matters concerning both the creation and protection of assets, which are to be given for the benefit of another individual. Trusts and wills are interlinked as trusts are often created within an individual’s will. Trusts are commonly created as a way to plan for the future and have an element of control as to what happens to assets after death.
Those creating a trust are known as the settlor, and it is up to the settlor to decide how they wish their assets to be used in the trust. These decisions are then put into a legal document known as a trust deed.
