The Upper Tribunal
The Upper Tribunal is an appellate tribunal created by the Tribunals, Courts and Enforcement Act 2007. The Tax and Chancery Chamber is the part of the Upper Tribunal which, among other things, hears references arising from certain decisions and supervisory notices issued by the Financial Conduct Authority (FCA).
The Tribunal consists of specialist judges appointed by the Lord Chancellor. The judges of the Upper Tribunal (Tax and Chancery Chamber) are High Court judges as well as specialist tax, charity and finance judiciary. Most importantly, all judges are independent of, and in no way connected to, the FCA.
Solicitors Disciplinary Tribunal. (SDT)
Members of Chambers have represented a number of firms of solicitors and individual partners and other members of staff faced with investigations by the Solicitors Regulation Authority.
Jeremy Barnett represents a number of firms of solicitors and individual partners and other members of staff faced with investigations by the Solicitors Regulation Authority [SRA].
Advice has been given to major law firms, medium size practices, and sole practitioners on a range of issues that include acting with integrity, acting in the best interests of clients, and various compliance issues including conflicts of interest, self-reporting, mortgage fraud and financial services.
Jeremy Barnett secured a great result on a recently heard case at The SDT involving the largest ARP and run off cover in which there had been a default on record. No payments had been made towards the total due of approximately £2m following the Administration of Sheffield firm, AMS Law.

General Medical Council
A number of cases before both the Interim Orders Panel (IOP) and the Fitness To Practise (FTP) Tribunal have been conducted by members of Chambers. These include highly contested hearings involving allegations of dishonesty and clinical under performance where the panel has drawn back from erasure following detailed representations.
Members of chambers are regularly instructed on matters concerning the investigations into misconduct by healthcare professionals, with particular expertise in disciplinary actions relating to doctors.
Nursing and Midwifery
Nurses and midwives account for the largest group of healthcare professionals. The Nursing and Midwifery Council (NMC) provide the regulatory guidance to apply standards and judge fitness to practise.
St Pauls provides legal advice and representation to nurses and midwives on all matters before the Nursing and Midwifery Council, including fitness to practise, impairments, competence, and physical or mental ill health. The service we provide to our clients also crosses over other disciplines such as clinical negligence, nursing injury and employment law advice.
Primary Health Tribunal
The main legislative provisions relating to Primary Health Lists are contained in The National Health Service (Performers Lists) (England) Regulations 2013 – which sets out the procedures for:
- a) The investigation of concerns relating to performers;
- b) The suspension of a doctor from the list;
- c) The imposition of conditions;
- d) The inclusion and removal of performers.
Primary Care Trusts that remove a doctor from a primary health list, or performers list, may apply to an independent tribunal called the Primary Health Lists Tribunal (Health, Education and Social Care Chamber) for an order that the doctor (or other practitioner) be disqualified from appearing on all primary health lists throughout the jurisdiction.
There are two tiers to the Primary Health Lists Tribunal. The first tier will deal with the hearing itself, while the upper tier deals with appeals from decisions of the first tier.
