What is a Prenuptial Agreement?
A prenuptial agreement is a contract that is entered into before a marriage or civil partnership. Prenuptial agreements give couples the autonomy to regulate the finances both within their marriage and to define what will happen should it come to an end.
Whilst pre or postnuptial contracts or agreements are not absolutely binding in England, the court will seek to uphold the contract provided it is not tainted by unfairness. A court awarding one party different or greater provision is not, in itself, unfair. At St Pauls, we have experience of preparing pre and post nuptial agreements to protect your assets on the breakdown of the marriage or civil partnership.

St Pauls Chambers’ barristers have substantial expertise and experience in advising upon and drafting prenuptial agreements.
Our barristers have experience of both contentious and non-contentious matters, and members of the Family Team have a sound commercial understanding of the practical issues arising out of prenuptial agreements. Our expert family lawyers also have experience in advising and representing clients living in England and Wales who want to enforce agreements made outside the jurisdiction.
In addition to drafting prenuptial agreements, our family lawyers are often instructed to appear as advocates in cases where there is a dispute about the validity of a prenuptial agreement. Effective and polished advocacy is essential in these cases. At St Pauls Chambers, we always ensure that Barristers of an appropriate level of seniority and expertise are available to meet clients’ individual needs. We are able to offer Barristers to advise on prenuptial agreements dealing with modest assets as well as those involving complex or multi-million pound assets.
