What is the NHS Performers List?
NHS England operate a medical, dental, and ophthalmic performers list. These three lists work to provide reassurance to the public that GPs, Dentists, and Opticians practicing within the NHS are all qualified with the relevant training, having good English language skills, and have passed all other checks.
Any changes to performers lists are done by Primary Care Support England (PCSE). The decision to admit or decline an applicant to the National Performers Lists is the responsibility of NHS England.
A prospective member to the list may appeal a decision to refuse their application for inclusion on the list. A member on the list may also have conditions imposed on their membership and this may also be appealed. NHS England may also remove a performer from the list.
The NHS Performers List and St Pauls
Our Barristers have experience of representing Doctors when NHS England seek to remove them from the National Performers List. If a practitioner is removed from the list, any appeal is made to the First-Tier Tribunal (Primary Health Lists). Some appeals are decided on the papers but oral hearings do take place in certain circumstances, such as when there is a disagreement as to the facts. Our Barristers will be able to advise Doctors as to the prospects of success and also represent them at the Tribunal hearing.
If a Doctor or Dentist faces conditions being imposed or is removed from the list, it is common for that professional’s regulator (the GMC, GDC or GOC) to be informed and the professional may face action being taken against them by their regulator. Since our Barristers operate across the whole range of healthcare regulatory law, we will be able to advise health professionals to ensure that their position is protected as much as possible from further proceedings by their own regulator.
