Family Arbitration
Arbitration is suitable for all forms of family financial disputes, whether arising from divorce, dissolution of a civil partnership, or separation after living together. It offers a bespoke solution to those who are unable to reach a consensual resolution to their financial dispute but who wish to avoid the courtroom. It is voluntary, but once the parties submit, the decision is binding and will be made into a consent order to be placed before the Court for approval. Only in very exceptional circumstances will the Court decline to approve the arbitration award. Arbitration in financial proceedings has received wide spread judicial approval.

Family
Arbitration offers a bespoke dispute resolution alternative in which the parties to the dispute retain control over the procedure, the timing and even the venue, each of which can be tailored to the needs of the parties and their legal advisors. It offers a completely confidential alternative to the court process (where members of the press may attend) and enables the parties to retain control over the timing of the determination of the dispute and avoid the inevitable delays as a result of over-burdened court lists. It is a cost effective and timely alternative to the court process.
The parties can choose and have confidence in their judge who will deal with the dispute from start to finish, unlike the court process where the parties have no control over who hears the case and have no guarantee of judicial continuity. Arbitration services can be used to decide all financial matters or specific aspects of a dispute. The parties can agree to invite the arbitrator to determine issues after considering written arguments or have a full oral hearing. An arbitrator can make both interim and final decisions.
