Commercial Disputes at St Pauls Chambers
The St Pauls Public Law team is well placed to help you to assess your own obligations and resist demands so that you do not do more than you are obligated to do.
We are aware that the cost of a Judicial Review might be dwarfed by the cost of not judicially reviewing a decision. We understand how decisions taken now about how to comply with the regulations governing your business will have an impact for years to come and we are able to scrutinise those decisions now, with the aim of providing your peace of mind going forward.
As St Pauls Chambers has always embraced a wide variety of work, we have an unrivalled ability to understand how business works. There is no point in advice that Judicial Review is available to you if the gains are marginal and the on-cost enormous.
We are used to examining from every aspect – from the risk of exposure to criminals to the need to comply with regulations issued by an independent body, as well as decisions made by a local authority on whose business or favour you rely. We are able to examine your problem from every angle and ensure that the advice you receive is commercial advice, aimed at securing the best possible position for you and your business.
We can be instructed directly, using the direct access scheme, ensuring that you only pay for the advice you need, and that the cost is both controllable and that you can decide whether further cost is justifiable before incurring it. If you are interested in instructing counsel, we encourage you to contact our clerking team who will be happy to assist and offer advice.
What are Commercial Disputes?
Commercial disputes include anything in relation to transaction breach. This includes: unpaid business bills, unfulfilled or disputed contract terms, landlord-tenant issues and insurer liability.
The impact of regulation and legislation upon the conduct of business has grown exponentially over the last 30 years and there is no reason to believe this will change. In fact, the exit from the EU is currently focusing minds on the mass of regulation and legislation which the UK has enacted to reflect European Law and, despite the voices promising less regulation there is, as yet, no promise or indication that the burden will diminish.
That means that your business is likely to be subject to increasing demands from public bodies; both regulatory – for instance, new Data Protection Regulations (GDPR) with financial penalties for breach – and legislative, as the UK enacts new legislation (mostly secondary) to replace the EU legislation that may no longer apply.
