Court of Appeal Success for Jon Gregg

Jon recently appeared before the Court of Appeal, Criminal Division, having previously advised that the four-and-a-half year sentence imposed upon Colin Miller by Minshull Street Crown Court in Manchester was manifestly excessive.

Mr. Miller had pleaded guilty to arson being reckless as to whether life was endangered, having set a fire in a terraced house in Oldham.  The Court of Appeal agreed with Jon that the sentencing judge had taken too high a starting point, having overlooked a number of important features, and wrongly relied upon the case of R. v George Frankham [2008] 1 Cr.App.R.(S.) 27, a case which involved setting fire to a house in a pre-meditated act of revenge.

The original sentence was quashed and replaced with one of three years and four months.
