Ayesha Smart Secures Acquittal for her Client

Following a three-day trial at Lancaster Crown Court, Ayesha Smart, instructed by Messrs. Watson Woodhouse, secured the acquittal of Mrs Maria Yorke on charges of making threats to kill, criminal damage and theft.

Ayesha Smart was instructed by Messrs. Watson Woodhouse of Middlesbrough to defend Mrs Maria Yorke at trial. The Defendant was initially accused of making threats to kill against her ex-partner, which involved throwing and putting a knife to the Complainant’s throat. In addition, she was also accused of causing damage to items of the ex-partner’s property and stealing a quantity of his cash.  

The trial was heard at Lancaster Crown Court over three days. The Prosecution evidence came from the Complainant and number of res gestae accounts, namely a 999 call, bodycam footage and reports to both the police and the landlady of a local pub.

At the close of the prosecution case it was submitted that there was no evidence in respect of the count of theft. The Judge therefore directed the jury to return a NG verdict at half-time on count 3.

The issue left for the jury revolved around the credibility of the Complainant and the factual dispute between parties. Acquittals were returned on the remaining counts of making threats to kill and criminal damage within 25 minutes of the jury retiring
